October 20, 1980 ' <br />Department of Natural Resources <br />Re: MLRS File No 80-47 <br />Page Four <br />(1) fill density/moisture and compaction; <br />(2) fill integrity and slope configuration; and <br />(3) precipitation and groundwater infiltration and migration. <br />The design of the specific monitoring program will, prior to the <br />placement of spent shale in the disposal area, be submitted [o <br />the Staff Director for review. <br />(3) With respect to Ptr. Zimpfer's letter o`. October 3, 1980 to Mr. James <br />McArdle, the operator commits to the following: <br />(a) The operator will submit a map depicting the proposed final <br />topography of the areas disturbed within the permit areas said <br />map will be in sufficient detail to portray the direction and <br />slope of all proposed reclamation of disturbed lands. <br />(b) Prior to commencement of construction of the proposed Davis Gulch <br />and Middle Fork dams, the operator will submit final design plans <br />to the Staff Director. <br />(c) The operator will, prior to the removal of sediment from behind <br />either the Davis Gulch or Middle Fork dam, submit an operating <br />plan for such dam, The plan will address an estimate of sediment <br />accumulation and proposed frequency of sediment removal. The <br />operator will, after removal of said materials, provide the Staff <br />Director with mutually acceptable analyses of the removed material, <br />plans for disposal of the material and proposed methods to Comply <br />with Rule 6.1 (d), if applicable. Data on the analyses of the <br />sediment will be available to the Staff Director upon request. <br />(d) The operator will, as soon as practicable, submit representative <br />stream channel cross-sectional profiles of the Davis Gulch and <br />Piiddle Fork areas. <br />(e) The operator will, as soon as practicable, submit longitudinal <br />profiles of the stream channels within the vicinity of the Davis <br />Gulch and Middle Fork dams. <br />(f) The basrs of the design of the surface drainage system for the <br />spent shale area will, as soon as practicable, be submitted to <br />the Staff Director to amend and supplement the application. <br />(g) The maximum velocity of runoff from the permanent diversion for <br />the Middle Fork dam is 65 feet per second. <br />(h) The maximum velocity of runoff from the spent shale disposal <br />area during a design event is 3 feet per second. <br /> <br />
