" ~ • ~' (Cortez Pit) <br />.. ~' . <br />t <br />h1EMORANDUM OF UNDF,RSTANDING OF PARTIES <br />'Chis hlemorandum made this date by and between Nielsons, Incorporated, <br />Dolores, Colorado 81323, hereafter referred to as Nielsons; and <br />hontezuma County Cormissioners, Montezuma County, Colorado, Hereafter <br />referred to as County Commissioners. <br />whereas, Nielsons presently has an active gravel operation producing <br />materials for the local requirement from a pit located Southwest of <br />Cortez on lands owned by Nielsons and described as follows: <br />west 1/2 of Section 5 less Tract A and Tract B shown on <br />tl~e attclied plat, all in Township 35 North, Range 16 lUest, <br />N.M.P.M. <br />Whereas, Nielsons is desirous of making the County Commissioners <br />aware of Nielsons plan of operations and reclamation plans for these <br />gravel producing operations in order that they may be compatible with <br />the requirements of the County Commissioners. <br />It is the understanding and agreement of said parties, to wit: <br />NIELSONS PLAN OF OPERATIONS <br />1. Nielsons will strip any soil overburden and stockpile <br />nearby for later replacement on disturbed areas. <br />2. Nielsons are performing a quarry type operation that <br />requires drilling and blasting of a solid sandstone rock. <br />Blasting will be performed during daylight hours only. <br />3. The quarry site is in a shallow canyon and not readily <br />visible to the traveling public. <br />4. Nielsons will abide by all regulations of the Colorado <br />.Bureau of Mines. <br />NIELSONS RECLAMATION PLAN <br />1. The removed overburden will be replaced other than on <br />steep rock slopes. <br />2.
