of July 6, 1976, is fulfilled. A x4,000.00 investment certificate
drawn on the United Bank of Grand Junction, accepted previously by
this office in lieu of a performance bond, has been returned. All
other terms, conditions, stipulations, and details of grant in the
Decision of July 6, 1976, as amended by the Decision of March 28,
1978, remain in full force and effect.
The State Office Decision of October 19, 1979, effective July 2, 1919,
approving the assignment of the right-of-way grant to Wyoming Fuel
Company, contained a provision stating that a formal application in
writing to the Colorado State Office should be made at least 9 months
'before the expiration date of the grant. No application for renewal
was filed in this office by October 5, 1980, the requested time limit.
Unless this office has an application to renew grant C-23190-RW from the
holder by January 5, 1981, no further communication will be made on this
granted right-of-way which shall then expire by its own terms on July 5.
1981.
Field personnel have recommended that the one-sheet map entitled,
"Proposed Tramroad Construction, Abandonment, and Restoration," filed
by the grant holder on November 22, 1977, and incorporated into the
grant by the Decision of March 28, 1978, is an adequate survey of the
tramroad segment constructed. We have determined, therefore, that the
map filed on November 22, 1977, is adequate and hence no further detailed
survey is required of the holder of C-23190-RW as to the amended portion
of the grant.
ANDREW W.
