Box 15265 <br />Lakewood, Colorado 80215 <br />DECISION <br />Right-of-Way Orant Amended <br /> <br />• <br />IN ^[}LY 161[1 TI <br />CO-946(JB) <br />C-23190-RW <br />OC7 3 n 1980 <br />On July 6, 1976, Ralph Flesch & Sons, Inc., was granted right-of-way <br />C-23190 for a 2.6-mile long coal haulage tramroad, pursuant to the Act <br />of January 21, 1895 (28 Stat. 635; 43 U.S.C. 956), as amended, for a <br />5-year term across public lands in Sections 3, 4, 9, 10, and 11, T. 8 N <br />R. 78 W., 6th P.M., Jackson County, Colorado. On March 28, 1978, the <br />right-of-way grant was amended to allow abandonment and restoration of <br />620 feet of the granted tramroad and to allow construction of 317.28 <br />feet of new tramroad, pursuant to the Act of October 21, 1976 (40 Stat. <br />2743, 2776-2782; 43 U.S.C. 1701, 1761-1771). <br />A recent review of special stipulations to grant C-23190-RW has been <br />made by field personnel who have recommended changes to items 4~_7, and <br />9.of special stipulations to the Decision of July 6, 1976. The recom- <br />mendations involved deletion of special stipulations 4 and 7 and required <br />substitution of a performance bond in lieu of a certificate of deposit <br />to satisfy the requirements of special stipulation 9. Additionally, <br />field personnel requested a formal renewal application be filed by the <br />holder and gave a recommendation as to the adequacy of the 1977 survey <br />map presently on file. <br />This office has determined that the requested changes to the special <br />stipulations are adequately justified and that the changes can be approved. <br />Therefore, items 4 and 7 of special stipulations, contained in the Decision <br />of July 6, 1976, are deleted in their entirety. This office has determined <br />that a 54,000.00 performance bond, effective as of July 6, 1976, issued <br />by surety Empire Fire and Marine Insurance Company to principal Wyoming <br />Fuel Company, holder of grant C-23190-RW, binds the principal and the <br />surety to the United States of America to fulfill the requirements of the <br />subject grant.
