Oehler, Environmental Protection Specialist <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: M-2004-057, Reyher Trusts Pit 112 reclamation permit application, <br />ADEQUACY LETTER (Your correspondence dated November 16, 2004) <br />Dear Mr. Oehler: <br />Hopefully we will be providing herewith the necessary information and <br />clarification as addressed in your letter of November 16~h. This being the first <br />time I was extensively involved in the preparation of a reclamation pit application <br />I appreciate your assistance in addressing the items of discrepancy and/or <br />inadequacy. Recognizing that time is of the essence in this matter I stand <br />prepared to respond immediately to any and all items which have not been <br />clarified. Your adequacy letter arrived during a period I was away from the office <br />for several days and I understand an extension of the hearing date to January 1, <br />2005 was approved during my absence. <br />General: <br />Please find enclosed a copy of the survey map as prepared by Lance <br />Brundage, Brundage Land Surveying. as originally prepared on October 7 <br />2003 and as corrected on December 1, 2004 to reflect the correct legal <br />description of the site. The legal description as originally provided on the <br />first survey was incorrect. Mr. Brundage is a registered professional land <br />surveyor under Colorado license # 30087. Please note that the corrected <br />survey will address the proper description as you indicated was incorrect <br />in your comment on Item #2 - Exhibit A -Legal Description. <br />Exhibit C -Pre- Mining and Mining Plan Maps of the Affected Lands <br />3. Please find enclosed an Exhibit C which we have labeled as Pre Mining <br />Plan Map and Mining Plan Map by name. Exhibit C as enclosed herewith <br />is a duplication copy of the survey. <br />4. There are no adjoining surface owners of record adjacent to the pit site <br />over and above the owners (Reyher), i. e. Reyher owns all the property in <br />the N1/2 NE1/4 of Section 14, Township 22 South, Range 49 West. This <br />information has been entered on Exhibit C. All other owners adjacent to <br />Section 14, but not abutting the actual site, were notified of this application <br />
