• INTRODUCTION <br />This document is a Guideline only. Its contents are not to be interpreted by the <br />applicant/permittee or Wyoming Department of Environmental Quality (WDEQ) staff as <br />mandatory. This Guideline intends to assist applicants/permittees in understanding and <br />attaining the requirements of the Wyoming Environmental Quality Act (WEQA) and Land <br />Quality Division (LQD) Rules and Regulations addressing bonding topics. <br />This Guideline was developed as a joint project of the Wyoming Mining Association (WMA) <br />Reclamation Subcommittee and the LQD. The LQD has and intends to selectively and <br />periodically publish updated versions of the Cost Calculation Methods as contained in the <br />various Appendices. <br />APPLICABLE WEQA STATUTES AND LQD RULES AND REGULATIONS <br />This is a general summary of items from the WEQA. <br />W.S. §35-11-417: <br />Outlines some general provisions applying to initial bond and renewal bond <br />values. This statute outlines the concept of Partial Bond Release. <br />W.S. §35-11-418: <br />• Outlines acceptable bond vehicles. <br />W.S. §35-11-423: <br />Outlines procedures for bond release for coal and other mineral permittees. <br />W.S. §35-11-411(d): <br />Authorizes the WDEQ Director to establish the bond amount based upon <br />information submitted in the annual report, an inspection and other materials. <br />These items in LQD Rules and Regulations have some applicability to bonding. <br />Coal Rules and Regulations, Chapter 1, Section 2.(k) and Noncoal Rules and <br />Regulations, Chapter 1, Section 2.(i) defines bond. <br />Coal Rules and Regulations, Chapter 2, Section 3.(b)(xxi) requires that shared <br />structures be cross-referenced in the bonds of applicable coal permittees. <br />Coal Rules and Regulations, Chapter4, Section 2.(d)(ix) establishes a minimum ten <br />(10) year bond period for coal permittees. <br />Coal Rules and Regulations, Chapter 11 and Noncoal Rules and Regulations, <br />Chapter 6 outlines definitions and procedures for the self-bond program. <br />• <br />DE 10/2005 IV <br />
