14 . REMOVAL OF FIXTURES AND EQUIPMENT. Within sixty (60) <br /> days after an event of surrender or a termination of this Lease, <br /> Lessee shall in accordance with all applicable permits, laws and <br /> regulations and without unnecessary waste or injury to the Leased <br /> Premises, remove from the Leased Premises all of Lessee' s <br /> property. <br /> 15. MISCELLANEOUS PROVISIONS. <br /> (a) Lessor shall be entitled to divert any and all water <br /> pumped by Lessee on the Leased Premises in connection with <br /> Lessee' s mining operation for purposes of irrigating other <br /> portions of the Leased Premises conditional that Lessor does not <br /> interfere with Lessee' s mining operations, and if permitted by <br /> law. <br /> (b) Lessee shall not conduct mining operations on any <br /> Saturday, Sunday or other nationally recognized holiday prior to <br /> 8 : 00 a.m. Once the mining operations are west of the existing <br /> cross fence running North to South dividing Lessor' s pastures, <br /> this limitation shall be waived on Saturdays . <br /> (c) Lessee shall, at no cost to Lessor, deliver sand to <br /> Lessor at Lessor' s riding arena in such quantity as reasonably <br /> necessary for Lessor' s use of said arena . <br /> (d) Lessee shall, haul, deliver, and grade, road base for <br /> use on other roads on Lessor' s adjacent property to the Leased <br /> Premises, not to exceed ten ( 10) loads per year. Lessor shall <br /> pay Lessee, , Lessee' s actual cost, without profit, for such <br /> material and labor. <br /> (e) Lessee shall not conduct any mining operations near <br /> other existing ponds on the Leased Premises, such that leeching <br /> or contamination shall result to said existing ponds . <br /> 16 . ENTIRE AGREEMENT. This instrument contains the entire <br /> agreement between the parties with respect to the transaction <br /> contemplated herein, and no representations are relied upon that <br /> are not set forth herein. <br /> 17 . LAWS AND GOVERNMENTAL REGULATIONS. All express and <br /> implied covenants of this Lease and all the terms and conditions <br /> thereof shall be subject to all federal, state and local laws, <br /> executive orders, rules and regulations, and this Lease shall not <br /> be terminated in whole or in part, nor shall the Lessee be held <br /> liable in damage for failure to comply therewith, if compliance <br /> is prevented by, or if such failure is the result of any such <br /> law, order, rule or regulations, or if such compliance is <br /> 11 <br />
