Lessor fails to pay said taxes when due, Lessee may, but is not <br /> required to, pay the same and receive credit for future royalty <br /> payments, or if no payments are owing to recover the same from <br /> Lessor, together with interest thereon at the statutory rate and <br /> any other costs incurred by Lessee in connection therewith. <br /> (b) Lessor hereby grants to Lessee all necessary access <br /> across the Leased Premises which is necessary to provide access <br /> to any excavating pits . It shall be Lessee' s responsibility to <br /> build and maintain any necessary access roads to any excavation <br /> site (s) , the location of which access road shall be mutually <br /> acceptable to both parties . Lessee further agrees that all <br /> mining activities shall commence at the southeast quarter of the <br /> Leased Premises, and progress to the west . <br /> (c) Lessor agrees to cooperate to allow Lessee to obtain <br /> and comply with and perform all of the terms and conditions of <br /> any Mining and Reclamation Permit issued by the State of Colorado <br /> Division of Minerals and Geology and the Mined Land Reclamation <br /> Board or. Office with respect to the subject project . <br /> 10 . RESERVATIONS OF LESSOR. In addition to any other <br /> reservations under this Lease, Lessor hereby reserves the <br /> following: <br /> (a) The right to go on the Leased Premises for inspection <br /> purposes at all times . <br /> (b) The right to use for general farming and livestock <br /> grazing and to maintain fencing, those portions of the Leased <br /> Premises which Lessee reasonably deems are available for such use <br /> without interference with Lessee' s operations . Lessor shall be <br /> solely responsible for erecting and maintaining any fences which <br /> are necessary to control livestock on those portions of the <br /> Leased Premises reasonably deemed by Lessee to be available for <br /> grazing purposes, and to prevent such livestock from entering <br /> into Lessee' s area of operations . Upon notification from Lessee <br /> that livestock needs to be relocated, Lessor shall timely remove <br /> livestock and any fencing as directed by Lessee . Lessee shall <br /> give Lessor at least thirty (30) days notice prior to the time <br /> that relocation of livestock is required. If any permit issued <br /> for the reclamation of the Leased Premises requires planting and <br /> establishment of ground cover, Lessor shall not allow livestock <br /> to enter upon the reclaimed area until such ground cover has been <br /> adequately established, and shall not allow livestock to <br /> overgraze any such reclaimed area so long as the bond or security <br /> posted by Lessee has not been released. Lessee and Lessee' s <br /> contractors, agents, employees, officers and directors shall not <br /> be liable for any injury or loss to livestock on the Leased <br /> Premises if Lessor has failed to erect and maintain adequate <br /> 8 <br />
