0 <br /> changes being either imposed by a regulatory agency or through <br /> refinement of plans by Lessee, must be approved by both Lessee <br /> and Lessor prior to any commitments to such changes being made <br /> with the regulatory authority. <br /> (c) When Lessee obtains all zoning and permits necessary to <br /> operate, he shall immediately notify Lessor in writing. In the <br /> event such zoning, permitting, or other authorizations have not <br /> been obtained within twelve ( 12) months, and after a good faith <br /> effort during that time, from the date this Agreement is <br /> executed, Lessor may terminate this Lease . If after a good faith <br /> effort by Lessee, Lessee determines that further efforts to <br /> obtain zoning, permitting, and other authorizations to operate <br /> are inadvisable, Lessee may cancel this Agreement . Should the <br /> expiration of this twelve month period be imminent and the <br /> necessary zoning and/or permitting not be completed, but Lessee <br /> is able to demonstrate good faith efforts towards completion, <br /> then this period may be extended for a period of three (3) months <br /> through notification in writing to Lessor . Any extensions beyond <br /> this three (3) month period will be negotiated between Lessee and <br /> Lessor. <br /> (d) If for any reason Lessee does not proceed with a sand <br /> and gravel operation on the Leased Premises, Lessee agrees to <br /> provide Lessor with copies of all exploration data including maps <br /> of drill hole locations, drill hole profiles, results of <br /> gradation tests and all other physical tests performed on the <br /> material samples, and further agrees that, in every respect, <br /> Lessee agrees to leave the Leased Premises in as good a condition <br /> as they are now, to the reasonable satisfaction of Lessor. <br /> (e) Lessee will provide Lessor copies of all zoning and <br /> permit approvals as they are obtained. Should Lessee need to <br /> modify any of the zoning and permit conditions during the term of <br /> the Lease, Lessee will notify Lessor of the changes being sought <br /> and obtain Lessor' s approval . Such approval will not be <br /> unreasonably withheld. Further, Lessee will provide upon <br /> request, Lessor copies of all required annual reports as they are <br /> submitted to the appropriate governing agency . <br /> (f) Lessee shall immediately have access to the Leased <br /> Premises to undertake such work or investigation as may be <br /> necessary in order to obtain necessary approvals and permits . <br /> The parties agree to cooperate and to execute such documents and <br /> take such actions as may be necessary to make such applications . <br /> (g) Lessee shall be solely responsible for all permit <br /> costs, reclamation costs, and bond costs . <br /> 3 <br />
