removed and sold from the Leased Premises, unless this Lease <br /> shall be terminated sooner under any of the provisions contained <br /> herein or by depletion of material reserves and completion of <br /> reclamation of the Leased Premises . <br /> 4 . ROYALTIES. Lessee shall pay to Lessor as royalty a sum <br /> equivalent to 28C per ton of Salable Materials removed from the <br /> Leased Premises during the term of this Lease, provided that if <br /> during the term of this Lease, Lessee' s sale price of materials <br /> changes, the amount paid Lessor per ton shall change in the same <br /> percentage effective for materials removed from the Leased <br /> Premises after the effective date of the change in Lessee' s sale <br /> price; except, however, the amount paid Lessor per ton shall <br /> never fall below 28C per ton. Payment of said royalties shall be <br /> made monthly during the term hereof . Payment shall be made by the <br /> 201h day of each month for all Saleable Materials removed during <br /> the preceding month. In the event royalties are not paid when <br /> due, then the royalty shall bear interest at a rate of 18% per <br /> annum and said royalties plus accrued interest shall be paid to <br /> Lessor. The term "Saleable Materials" shall include all <br /> materials taken from the Leased Premises which are salable by <br /> Lessee. The term "sale price" shall mean the current price <br /> charged by Lessee for the materials removed, exclusive of any <br /> sales, use, excise or other tax, duties, or similar assessments <br /> paid in connection with the sale by Lessee of the materials . <br /> S. MINE PLAN - RECLAMATION PLAN - ZONING AND PERMITS. <br /> (a) Once prepared in final draft, Lessee shall present <br /> Lessor with maps indicating the mine plan, equipment locations, a <br /> description of any ditches to be moved, and any fences that may <br /> be moved, removed or constructed in the course of operations <br /> hereunder . Lessee shall also present Lessor with a plan for <br /> reclamation of the Leased Premises affected by Lessee' s <br /> operations . All such plans must be acceptable to both Lessor and <br /> Lessee before submission to applicable authorities and before the <br /> commencement of any operations hereunder . <br /> (b) It is understood by both parties that it will be <br /> necessary to obtain zoning, permits, and other authorizations <br /> from federal, state and local governments or private entities <br /> before starting operations on the Leased Premises . Lessee shall <br /> be totally responsible for obtaining such authorization . Lessor <br /> agrees to cooperate and to join Lessee in applying for such <br /> zoning, permits and authorizations but this shall not be <br /> construed to financially obligate Lessor for the expense of these <br /> authorizations which expense shall be totally borne by Lessee . <br /> Any changes to the originally agreed to mining and <br /> reclamation plans or zoning and permitting restrictions, such <br /> 2 <br />
