5) Rule 6.4.4(i-, the applicant must submit a statement that specifies the use 'or <br />non-use of explosives. Please clarify and submit the appropriate statement. <br />6) Rule 6.4.5(v), in the Reclamation Plan Exhibit, asks for a specified or range of <br />topsoil depths. It is in the applicant's best interest to commit to a range rather <br />than a specific minimum depth. This way if less topsoil is present than <br />anticipated there is room for error. The specified minimum is fine, however staff <br />recommends a range. The applicant should remove the phrase "to the greatest <br />degree possible" from the Mining Plan concerning topsoil placement as it is <br />vague and open to interpretation and replace it with the minimum or range. <br />7) Rule 3.1.9(1) requires protection of topsoil stockpiles from deterioration. The <br />applicant has stated in Exhibit D and E that the stockpiles will be seeded to meet <br />this requirement. Staff is requesting the applicant submit a seed mix and rate of <br />seeding for the stockpile protection measures. <br />8) In Exhibit E, volumes are stated for the placement of overburden over the entire <br />site. Staff requests that the applicant state a commitment to a depth range for <br />overburden placement that supports the volumes stated. <br />9) Per Rule 6.4.5(ii), the applicant must specify seeding types, mixtures, quantities, <br />and expected time(s) of seeding and planting. Please submit the required seed <br />mix information. <br />10) Exhibit F, the Reclamation Map is not signed per Rule 6.2.1(2)(b). <br />1 1) Exhibit G should address the OSE comments referenced above. Please supply <br />documentation of legal water rights, etc as required by the OSE. <br />12) There are some questions concerning the statement that no groundwater will be <br />encountered. Please be advised that by OSE definitions, irrigation water that <br />enters the ground changes from surface to groundwater. If the applicant <br />suspects that the site may encounter the seasonal influxes of this type of <br />groundwater the issue must be addressed. A commitment by the applicant not <br />to expose any groundwater will cover this. The commitment should state that if <br />groundwater is encountered, a minimum of two (2) feet of material will be used <br />to cover the area and not uncovered until the appropriate well permit has been <br />acquired from the OSE. <br />13) Please clarify in Exhibit L, Reclamation Costs Estimate, how the applicant arrived <br />at the cost for seeding and fertilizing. <br />
