Dear Mr. Gesso:
The Division of Minerals and Geology has begun the review process for the above
referenced 112c application. Staff has completed a PAR of the application and is
requesting clarification or corrections to the following issues:
1 i The supplied maps do not have the required signature of the qualified person
who prepared them as required by Rule 6.2.1(2)(b). Please supply one original
and one copy of corrected versions of the maps with signature and any other
issues noted in the application review process.
2) Per Rule 1i.4.3(g), Map C-1, (man made feature) does not include the CJN Lateral
as listed in Exhibit S. Please correctly identify this feature on this map.
3) In the Mining Plan, Exhibit D, the Office of the State Engineer (OSE) has
submitted comments (attached) concerning noted Water Diversions and
Impoundments. Please supply this Office with a copy of Haldorson's responses
to OSE concerning the issues noted.
4) Per Rule 3.1.3, "reclamation must be carried out with all reasonable diligence
...and completed within five (51 years from the date such phase is completed."
The commitment to 2 years from total completion of mining to final reclamation
in the Mining and Reclamation Plans is admirable, however, staff feels the
applicant should allow for the full 5 years. If the site is ready for release anytime
within that time frame, the applicant could apply for a release. But if the
applicant commits to 2 years and does not meet the reclamation requirements,
staff would be forced to look at a possible permit violation and associated
penalties. Experience with reclamation work in this area does not support the 2
year commitment. -
