Richard D. Lamm
Governor
DEPARTM~T OF NATU III IIIIIIIIIIIII III •
D. Monte Pascoe, E,ecuhve Director 999
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTON Director
March 3I, 1982 -
Mr. Bill Malouff
P. O. Box 120
Alamosa, Colorado 81101
R6: Bucky Clanch Pit
Our File H82-33
Dear Mr. Malouff:
Enclosed please find the receipt for your 5125.00 permit fee.
a
On Thursday, March 25, 1982, the Mined Land Reclamation Board granted a
continuance of consideration of the mining and reclamation permit application
for the above captioned operation until the April 2I-22, 1982 meeting. It
was further moved that payment of any portion of the $10,000.00 civil penalty
be deferred until the May 26-27, 1982 Board meeting contingent upon the issuance
of a permit by that time.
As explained to you Last Thursday, you must complete the two sequential weeks
of publication(format outlined on the back of Complete Letter of 3/11/82) be-
fore the Board can consider the application. Although there are no adjacent
landowners to the Clanch property, you must notify Mr. Clanch himself by sending
him a copy of the first publication by certified mail. You should then supply
our Division with proof of the publications and notification in the form of a
copy of the publisher's affidavit (or copies of both publications if the affidavit
is not yet available) and the green certified mail return receipt signed by
Mr. Clanch. Also, a copy of your application should be placed with the Conejos
County Clerk for public review.
Application Items - Please clarify these items.
ll. As you told me last Thursday, the correct county for this operation
is Conejos, not Alamosa.
12. Given a ~00' x IS00' permit area, the total acreage for this permit
now works out to be 8.3 acres. Is this correct?
I4. s 15. As Z mentioned in my letter of March 11, 1982, Z presume that the
present land use for the 8.3 acres of this operation would be gravel extraction
and agricultural (limited grazing where gravel has not yet been extracted), and
that the future use will be agricultural (sheep pasturing or corral).
16. Our Division still needs the original copy of the 2-page application form
with your signature. I suggest that you properly fill out the items on the form
as discussed above and send it to our Division as an easy way of clarifying all
these matters.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel (303) 866-3567
