EXHIBIT D (CONTINUED) (Revised 02/07/95) The excavation will proceed from south to north and east to west in the phases as shown on the accompanying MINING PLAN MAP, EXHIBIT C- 2. Except for installation of the slurry wall, no excavation shall occur within 25' from adjacent property lines. Some areas, as is explained in the next paragraph, will have special setback requirements for any excavation. Except for those areas mentioned in the next paragraph, mining from the minimum 25' setback requirement may be undertaken vertically. After mining for reclamation, all slopes shall be no steeper than a ratio of 3:1 slope. Special setback, sloping, and mining requirements shall apply in following areas: 1. Along Monaco Street and 88th Avenue, and within 200' of any adjacent man made structure, no vertical mining will be allowed from the 25' setback line. A temporary 1:1 mining slope shall be allowed, provided any slope within 200' of the man made structure is immediately backfilled to the previously mentioned above standard after mining has been completed in these areas. 2. Along the Wyco pipeline, no mining shall occur closer than 50' on either side of the centerline of the pipeline. Even temporary sloping shall not be steeper than 3:1. 3. From the center of the Bull Seep Ditch, no excavation shall occur closer than 50' on either side of centerline of the Ditch. Even temporary sloping shall not be steeper than 3:1. 4. All mining, including sloping, final elevations, improvements, etc. within the "Area 2A - South Platte River & Berns Area" shall be subject to approval of the UD&FCD. Improvements in the channel area will be installed prior to any mining occurring within this area, no mining shall occur north and west of the eventual location of the riprap trenches. Prior to beginning extraction, 6' chain link fencing will be installed where necessary to prevent access to the site. Where natural barriers, such as the South Platte River exist, no fencing will be installed. In areas where adjacent property owners have installed fencing, Cooley's fence will simply connect to the existing fencing. Two gates will be installed, one onto 88th Avenue and one onto Monaco Street at the proposed Truck Access Points. Both are shown on MINING PLAN MAP, EXHIBIT C-2.
