..

3. Cooley~s recollection is the same as mine. They agreed to only
double the amount of trees along the River. Therefore, what I
wrote in the previously revised plan is what Cooley wishes to
stay with on this issue. I have revised that portion of
EXHIBIT E - RECLAMATION PLAN NARRATIVE (attached) to
specifically exclude Russian Olive trees. This revised
narrative portion of the exhibit will also be included in a
revised booklet incorporating all the changes from the
original application, after the approval is granted.
4. The same survivability index for shrubs that was utilized for
trees (SOo) has also been incorporated in that portion of
EXHIBIT E - RECLAMATION PLAN NARRATIVE (attached). This revised
narrative portion of the exhibit will also be included in a
revised booklet incorporating all the changes from the
original application, after the approval is granted.
If this letter doesn't resolve your concerns, by this letter you
are hereby given permission to extend the decision date by two
additional weeks to February 22, 1995. Cooley is also willing to
have another meeting with the Division of Wildlife, or take these
final items to the Board for decision in February. Both myself and
Cooley's representatives that were at our meeting in December with
UD&FCD and the Division of Wildlife, feel that what I originally
wrote, is what was agreed to at that meeting. Cooley feels it has
been more than reasonable, but if the Division of Wildlife wants to
fight for the exclusion zone and the extra trees and shrubs beyond
what Cooley has already offered, then Cooley is willing to have the
Board make the final decision. Please let me know how you want to
proceed.
Sin erely,
//1/ ,
o ert N. Fl~~g
cc: Cooley Gravel Company, c/o Mike Reefer
