Cooley would like to propose the <br />following, with the numbers corresponding to those in your letter: <br />1. The line you outlined on the FAXED map is OK, but only as a <br />temporary exclusion area until UD&FCD plans are completed. <br />This area will be disturbed by the UD&FCD channel <br />improvements, specifically the rip-rap trench and grade <br />control structure. The accompanying map, from the agreement <br />with UD&FCD and Cooley, shows conceptually these improvements. <br />It was always the intent to install these improvements <br />wherever UD&FCD determined they should be located, and then <br />install the slurry wall behind (to the south and east) of the <br />riprap trench. <br />The reason that Cooley agreed to double the amount of trees <br />along the River was to replace those in this area that will be <br />destroyed by these actions. My note on the map already made <br />this a temporary non-disturbance area until UD&FCD plans are <br />finalized. Cooley is willing to change the map to reflect this <br />temporary exclusion area as the area you marked on *_he map ycu <br />FAXED me. This map would then be submitted in the revised <br />booklet incorporating all changes from the original <br />application, after the approval is granted. Cooley is also <br />willing to make it clear that no mining will occur north and <br />west of the eventual location of the riprap trenches, and I <br />have changed two pages of EXHIBIT D (Mining Plan Narrative) to <br />make this clear. <br />2. Your statement on ground cover is acceptable, as it relates to <br />areas north and west of where the riprap trench and slurry <br />wall would eventually be installed. Item 4 of the EXHIBIT E - <br />RECLAMATION PLAN NARRATIVE has been revised appropriately and <br />is attached. This revised narrative portion of the exhibit <br />will also be included in a revised booklet incorporating all <br />the changes from the original application, after the approval <br />is granted. <br />
