Walther <br />Arvada, CG 80002 E=ecueve Director <br />Michael 9. long <br />Divisbn Director <br />Re: File No. M-2001-046, Na Sand ertd Gravel Mice, 11Zc Decision Letter - Condition, FSnancial and <br />Perforrnmce Warranty Request -Construction Material Operation <br />Dear Mr. Owens: <br />On May 37, 2002, the Divisicu of Minerals and Geology approved yow 112c mining pemrit application will conditions. <br />The cortditiens to the approval ate noted below: <br />Stipulation No. 1 <br />The operator will not mine within 200 feet of any oil or gas stntcbrre owned by Patina Oil and Gas Company or <br />the Ketr-McGee Company, umil a nMarized damage agreement with those companies is submited to DMG. A <br />suitable stmctural stability analysis can also be submitted in lieu of an agreement, if none can be reached. Tha <br />agree+rtent or analysis should inchlde the well-head and associated aquipmetlt, gathering lines, and the storage <br />tanks and accessories. <br />Stipulation No. z <br />The operator will not begin mining until an agreeme~ is reached with the owners of the Side Hill Ditch for the <br />establishment of a new headgate/diversion pout and associated delivery system that will provide an alternative <br />water supply W the Parker wetland. This agreemem must be submitted to and approved by the division prior w <br />initiating mining activities. <br />Stipulation No. 3 <br />The operator will not expose groundwater in them mining operations until the State Eagineer's Office approves <br />their Gravel Well Peratit and their Substitute Supply Plau for augmentatica of water lost through rho mining and <br />reclamatiagt process. Tf groundwater is exposed, the operator will be required to post a financial warLanty for the <br />cost of bac)¢'illing the attire proposed mining area to an elevation of two fect above the static grolmdwa[er level. <br />Stipubrlion No. 4 <br />The operator will implement the groundwater monitoring system as outlined in the Wright Water Fagineers, Inc. <br />Memo dated May 13, 2002. At !oast one year of data (begirming in fall of 2001) will be colleued prior to <br />initiating mining activities at the Nix Sand and Gravel Mine. Based on observation of collected data, an <br />augneptation trigger mechanism will be proposed to DMG and approved by DMG prior to initiating mining <br />activities. This trigger mechanism should be specific with respell to when augmentatim would begiq and the <br />augmentadion plan should ba specific as to volumes o£water involved, times of year for delivery, and length of <br />
