Ok, as far as bonding , the staff hasn' t had an
opportunity to inspect this 8.47 acres to determine the status of reclamation
if any and therefore feels if that until we can make an inspection it needs to
be included as affected acreage and uh, presumably the operator has moved into
phase 2 now, so we need to include that 3. 19 acres, so that amounts to approxi-
mately 11 .66 acres, and the other 2 areas, this is a floating bond and the bond
can be adjusted accordingly over time. Staff does recommend approval with a
floating bond set at $770 an acre for a total of $9000.
RW: Ok, and an NPD and that appears to be yet coming so that
RF: I believe, hir. Nottingham do you have your NPDES permit yet? Your discharge
BN: We do not have one on this operation - we are not required to have one on
this operation.
RF: Ok, I was under the understanding that you had made application for. . .
BN: No that was filing error we did.'not, ,
RF: Ok
RW: So eliminate that
RW: Ok, so are there any objections to the application.
RF: No, the uh, main reason this application was held up for a period it was , was
there was a uh, a problem with the operator obtaining a special use permit
and county approval from Eagle County: and Uh, there was a very long series of
negotiations, which were finally, that application essentially has been adequate
for considerable time and it was the county approval that was holding up this
presentation. and that has been solved.
SB or LB: Ok, Mr. Chairman, I would move then that a permit be granted to Nottingham
Sand and Gravel , File No. 77-343, for sand and gravel operation in Eagle County,
and bond be set at $9000.
K: Sir, excuse me, I represent the Rio Grande Railroad, and would like to say a
few words.
RW: Just a second, let ' s get the motion in. . .
K: Oh, I 'm sorry, I didn' t want
RW: Yeah, right
RW: Is there a second to that motion
Yes , I second that
RW: Ok, Ok, then the Board certainly, jsut tell us your name and uh the floor is
yours.
K: Ok, my name is Charles Kerd, I represent the Rio Grande Railroad and I think
that Mr. Nottingham know s we've had considerable correspondence with him,
with Eagle County over this application here at Avon, Colorado . the property
which is subject to the permit would have to be uh, our railroad would have to
be crossed to get into this property and there's a private crossing there
RF: The railroad is right here, the permit boundary runs like this.
RW: Where's the location approximately of the private crossing, the private acces
there across the railroad.
K: A railroad map but I didn ' t know how it would relate to this particular map
