<br /> that was used by the Highway Department in revegetation on Vail Pass, and
<br /> has been quite successful . Ok, as far as bonding , the staff hasn' t had an
<br /> opportunity to inspect this 8.47 acres to determine the status of reclamation
<br /> if any and therefore feels if that until we can make an inspection it needs to
<br /> be included as affected acreage and uh, presumably the operator has moved into
<br /> phase 2 now, so we need to include that 3. 19 acres, so that amounts to approxi-
<br /> mately 11 .66 acres, and the other 2 areas, this is a floating bond and the bond
<br /> can be adjusted accordingly over time. Staff does recommend approval with a
<br /> floating bond set at $770 an acre for a total of $9000.

<br /> there was a uh, a problem with the operator obtaining a special use permit
<br /> and county approval from Eagle County: and Uh, there was a very long series of
<br /> negotiations, which were finally, that application essentially has been adequate
<br /> for considerable time and it was the county approval that was holding up this
<br /> presentation. and that has been solved.

<br /> which is subject to the permit would have to be uh, our railroad would have to
<br /> be crossed to get into this property and there's a private crossing there
<br /> RF: The railroad is right here, the permit boundary runs like this.

<br /> there across the railroad.
