percent of the annual pumpage in each of these basins. This depletion is <br />insignificant and probably will not impact appropriators of water in these <br />basins. <br />5. Pumpage from Well No. I probably will reduce the annual streamflow in Sage <br />Creek by up to 0.74 acre-foot (1.3 percent of the annual pumpage) in the 15th <br />year of mining. From May through September, the total streamflow reduction <br />will be about 0.31 acre-foot. <br />6. The decreed springs and well in the vicinity of the Seneca II-W Mine probably <br />will not be impacted adversely by excavation of the mine pit areas. <br />7. The existing water uses on Dry Creek downstream from Pond 006 and on Sage <br />Creek downstream from the Trout Creek Sandstone outcrops are for irrigation <br />purposes. Water is used for irrigation from May through September. When the <br />streamflow in Dry Creek and Sage Creek is insufficient for the existing uses, <br />Peabody will replace its out-of-priority depletions. <br />8. Peabody has leased a portion of the water available to the J.C. Temple <br />Reservoir No. I and the J.C. Temple Ditch No. I to replace Peabody's out-of- <br />priority depletions with respect to Dry Creek. Specifically, the lease involves <br />36.1 acre-feet of historical consumptive use and 18.3 acre-feet of historical <br />retum flow, associated with 20 acres of irrigated alfalfa. This water will be <br />regulated in J.C. Temple Reservoir No. I and released to Dry Creek to replace <br />(I)out-of-priority storage in Pond 006 and (2) the historical return flows from <br />the irrigation of 20 acres of alfalfa. <br />9. Peabody will construct Pond Y-I on a tributary to Sage Creek and will obtain a <br />new water storage right. Water will be stored in this reservoir during the non- <br />irrigation season and will be released to Sage Creek during The irrigation <br />season to replace out-of-priority depletions caused by pvmpage of Well No. I. <br />Up to 0.31 acre-foot will be released to Sage Creek at the direction of the <br />Water Commissioner. Such releases will be initiated during the first mining <br />season and will continue for 20 years after mining activities cease. <br />10. If any of the inactive storage reservoirs on Sage Creek are reconstructed, <br />Peabody will haul water from Wadge Pit Reservoir on Grassy Creek for <br />regulation by Pond Y-I or for direct release to Sage Creek as directed by the <br />Water Commissioner. Such water will be delivered for replacement of out-of- <br />priority depletions in Sage Creek caused by the Well No. I pumpage. <br />17 <br />
