25. Exhibit C-1, Pre-mining Plan Map, indicates that some existing buildings located on the proposed site will be removed <br />for mining. A notarized agreement is required from the current property owner authorizing removal of these stmctures, <br />or transfer of ownership to the Operator of these stmctures is required prior to approval of the pemrit. <br />Rule 6.5 Geotechnical Stability Exhibit <br />26. Section (2) of the Geotechnical Stability Exhibit states that on asite-specific basis, an Applicant shall be required to <br />provide engineering stability analyses for certain slopes configuration as they will occur during operations, including, but <br />not limited to emban}mtents. The Geotechnical stability exhibit submitted with the pemtit application is being reviewed <br />sepazately by Allen Sorenson within the Division of Minerals and Geology, and any adequacy review comments related <br />to this exhibit will be addressed in a sepazate letter at a later time. <br />Because objections were filed, this matter must be set for a hearing before the Mined Land Reclamation Boazd. The tentative <br />date for the hearing is July 30, 2003. However, the Division will need to make a recommendation by July 3, 2003. Please be <br />advised that the SW Meadow LLC, Heit Sand and Gravel, 112(c) Pemtit Application may be deemed inadequate, and the <br />application may be denied on July 3, 2003 unless the above mentioned adequacy review items aze addressed to the <br />satisfaction of the Division in a timely manner allowing for adequate tune to review the responses. If you feel more time is <br />needed to complete your reply, the Division can grant an extension to the recommendation date. This will be done upon <br />receipt of a written waiver of your right to a recommendation by July 3, 2003 and request for additional time.
