Rule 6.4.8 Exhibit H-Wildlife hrfom~ation <br />18. Section (1) (a) of Wildlife Information requires the ApplicanUOperator to include a descripfion of the significant wildlife <br />resources on the affected land. The petmit application includes only a statement that the Preliminary Conservation <br />Planning Area Summary acquired from the Colorado Natural Heritage Program indicated that there may be known <br />threatened or endangered species of plant or animals in the general azea of the proposed permit azea, but that the PCA did <br />not indicate any known threatened and endangered occurrences specifically in Section 13, Township 2 N, Range 67 W. <br />Please specify the significant wildlife resources on the affected land. In developing this information, the <br />ApplicanUOpemtor may wish to contact eh local wildlife conservation officer. <br />19. Section (1) (c) requires the ApplicanUOperator to included the presence and estimated population of threatened or <br />endangered species from either federal or state lists. In that the azea and the habitat present on the proposed site may <br />likely be home to federally listed species, it is necessary for the Division to receive a letter from the U.S. Fish and <br />Wildlife Service indicating that the mining plan bas clearance through them prior to approval of the permit. Please <br />contact the U.S. Fish and Wildlife Service regazding the proposed mining operation. <br />20. Section (1) (d) requires the App]icanUOperator to include a description of the general effect during and after the <br />proposed operation on the existing wildlife of the azea, including but not limited to temporary and permanent loss of food <br />and habitat, interference wiUr migratory routes, and the general effect on the wildlife form increased human activity, <br />including noise. Please include the above requested information regazding the operation's effect on wildlife at the site. <br />Rule 6.4.10 Exhibit J - Vegetaton Information <br />21. Section (1) (a) of Vegetation Information requires the ApplicanUOperator to include descriptions of present vegetation <br />types, which include quantitative estimates of cover and height for the principal species in each life form represented (i.e. <br />trees, tall shrubs; lew-shrubs, grasses, ferbs). The in€ormetierr submitted-with the-applieatiea does aot dem3te this <br />information. Please submit the above requested information regazding the current vegetation at the site. <br />Rule 6.4.12 Exbibit L -Reclamation Costs <br />22. The Division will estimate the cost to reclaim the site once the applicant addresses the concerns noted in this letter. The <br />Division will estimate a cost to reclaim the site based on the informafion submitted in the application and responses to <br />this adequacy review, however, the Division also needs the following information: <br />Please list all structures that will be constructed on site including their composite, dimensions and method of <br />reclamation. <br />In the bond estimate, it is implied that 61 acres will be graded. This acreage seems higher than what was estimated <br />on the mining and reclamation timetable. Please clarify. <br />Rule 6.4.19 Exhibit S -Permanent Man-made Stmctures <br />23. Exhibit S requires the ApplicanUOperator to provide a notarized agreement between the applicant and the person(s) <br />having an interest in the strncture, that the applicant is to provide compensation for any damage to the stmcture; or where <br />such an agreement can not be reached, the applicant shall provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities occurring at the mining operation. Where such <br />structure is a utility the Applicant may supply a notarized letter, on utifity letterhead, from the owner(s) of the utility that <br />the mining and reclamation activities, as proposed, will have no negative effect on their utility. All groundwater wells <br />within 200 feet of the affected land should be included on the list of strnctures. Please clarify this discrepancy. <br />24. The Geotechnical Stability Exhibit is being reviewed sepazately (see item 26). Results of this review will detemtine <br />whether mining can occur closer than 200 feet from any manmade strnctures. Depending on the results of this review, a <br />notarized agreement may be required from owners of these structures, or setbacks may have to be altered thus affecting <br />the Mine Plan Map, Exhibit C-3. <br />
