These concerns are the method by <br />which ground water inflow quantity and quality will be <br />measured, the method for determining whether water in excess <br />of that found in the existing mine is encountered in the new <br />area, and insuring that we do not concede that OSM has <br />jurisdiction in water right matters. <br />Concerning the water right question, I believe that the <br />statement by OSM is acceptable since it does not place OSM <br />in the position of making an independent determination <br />concerning your water rights, but merely allows them to <br />ascertain whether you have obtained adequate rights under <br />Colorado water law.
