Lnrhhead <br />6e<wtve Dvecta <br />rn~ch~el H Lonl; <br />Dtvi,ton Dneaot <br />This letter is being written to address technical inadequacies within the 110 permit application <br />submitted by your company, #M-98-034, Parshal Pit. The following issues need to be resolved <br />before the Division of Minerals and Geology (DMG) can consider approving your application: <br />,~1) In Exhibit D, Reclamation Plan, p. 5, it is mentioned that topsoil will be stockpiled along the <br />southern edge of the settling ponds, and "seeded to grass and kept free of noxious weeds if they <br />remain on the site for longer than two yeazs". In accordance with Rule 3.1.9(1), the topsoil must <br />be seeded if it is to remain in place longer than one growing season. Please commit to a seed mix <br />(wheatgrass, for example) and seeding rate for these stockpiles. <br />2) Please commit to a specific minimum grade for the completed slopes, such as 3H:1 V. No <br />~ specific mention is made of the final grade for the reclaimed areas in either the Mining Plan or <br />Reclamation Plan. This requirement is in accordance with Rule 6.3.4(1)(b). <br />3) Please estimate the expected maximum depth of the excavation, and the depth to groundwater <br />/ in this area. While DMG understands that no groundwater exposure is anticipated, the Division <br />requires a written commitment from the Operator to notify DMG and the Office of the State <br />Engineer (OSE) immediately if an accidental exposure of groundwater occurs at the site, and to <br />backfill the exposed area with 2' of native fill until a consultation is held with OSE. <br />;/ 4) DMG is requesting that changes be made to the seed mix for the site. While the S.C.D. may <br />have recommended the wheatgrass mix proposed in this application, DMG believes it will not <br />satisfy the requirements of Rule 3.1.10(1), in establishing a"diverse, effective, and long-lasting <br />vegetative cover". Please submit a revised seed mix with greater species variety, the seeding <br />application rate, and method of application. <br />~) Exhibit L does not contain permission for the Operator to be within 200 feet of County Road <br />
