(A) Conducting the proposed surface mining activities within <br />100 feet of the right-of-way line of any public road, except where mine <br />•~ access or haul roads join that right-of-way; or <br />(B) Relocating the public road. <br />RESPONSE: <br />The haulroad will not be constructed, this section is no longer <br />applicable. <br />The Colorado Yampa Coal Company proposes to construct a haulroad <br />south of County Road #33 on property owned or controlled by Getty <br />Minerals Marketing, Inc., within the corridor shown on Map 6, Mine <br />Plan. Design Specifications for the haulroad are presented on Map 14, <br />Haulroad Profiles and Cross-Sections. <br />In order to minimize erosion, siltation, air and water pollution <br />• and damage to public or private property, CYCC will construct and <br />maintain the haulroad in accordance with the applicable performance <br />standard requirements of Rule 4.03.1(1) - 4.03.1(7). The following <br />description of the planned haul road demonstrates the use of the best <br />technology currently available to avoid damage to fish, wildlife and <br />related environmental values. All existing drainages affected by the <br />planned road will be maintained by the use of culverts and ditches <br />designed and placed in accordance with Rule 4.03.1(4). Horizontal and <br />vertical alignment, together with sedimentation ponds and other control <br />mechanisms, will achieve the suspended solids requirements of Rule <br />4.05.2. <br />• PRA 2.05-12 Revised 3/14/89 <br /> <br />
