D., 19 82__ by and between the State of Colorado for the use and benefit of State <br />Department of Highways, Division of Highways, the Lessor, and <br />CONSTRUCTION CO. <br />the Tenant, <br />WITNESSETH <br />IV1lEREAS, the Department of Highways has acquired certain land as right of way for <br />future use, and such land is not presently needed, <br />THEREFORE, in consideration of the sum of THREE HUNDRED AND THIRTY <br />years <br />($ 30.00 ) dollars cash in hand paid to the Lessor for the first monbhacrent and <br />security deposit in the amount of THREE HUNDRED AND THIRTY ($ 330.00 <br />the Lessor, pursuant to the authority conferred by C.R.S. 1973, Section 43-1-210(3), <br />does hereby rent to the Lessee, for the term of five (5) years, beginning at 12:00 <br />noon on the 1g~_ day of <br />19 82 , and ending a[ 12:00 noon on <br />, <br />the ~~_ day of June 19 g7 all of the following described <br />premises: <br />SEE ATTACHED EX}iIBIT "A" <br />1. Lease rentals shall be at a 10% increase over the past year rental rate due on <br />or before the 1st day of July each year, payable to Department of Highways, State of <br />Colorado, and mailed to Receipts and Deposits, West Annex, 4201 E. Arkansas, Denver, <br />Colorado 80222, hereafter during the term hereof. This lease may be extended for one <br />five year term providing the rental rate increases at 10% each year. <br />2. All rent payments must be received in Cash and Receipts by the 10th of the <br />month or we will charge a $10 late charge and $5 a day thereafter until received. <br />3. The premises hereby leased may not be sublet, nor assigned, without specific <br />written permission by the Property Planagement Section. <br />4. It is understood and agreed that the Tenant intends to ilse the premises for <br />a staging area for their equipment. <br />5. Lessor reserves the right to enter on leased area at any time to inspect area <br />or perform maintenance or reconstruction where necessary. <br />6. The Tenant shall keep the leased premises clean and free from trash, rubbish or <br />debris. <br />7. The Tenant shall not commit, nor permit the commission of, any act or thing <br />which shall be a violation of any ordinance of the County of Mesa, or of any law of <br />the State of Colorado or the United States. <br />8. The Tenant shall save and hold harmless, the Lessor from any liability for damage I <br />to persons or property resulting from occupancy of the leased premises. <br />
