Long <br />D'n~iswn Dheaw <br />I apologize far the lack of a timely response to Mr. Soker's question regarding a possible delay in effecting <br />repairs to the slumped pit slope on the Stage 1 pond. Repairs to the slump may be delayed until a decision <br />has been reached regarding use of the Stage 1 pond for an endangered fish species habitat project. <br />However, the Division still intends to conduct a routine reclamation cost update for this site in the near <br />future. Costs for repairs to this slump will be incorporated into the reclamation cost estimate. If the <br />Colorado Fish Recovery Program plans are finalized, appropriate revisions to Permit No. M-77-129 are <br />approved, and the inlet is constructed, prior to recalculation of the reclamation cost estimate, then costs for <br />repairing the slump will not be incorporated into the estimate. Please inform Mr. Soker of this <br />determination. <br />Whitewater Pit 512 - M-77-114 <br />Thank you for your notice that the first island has been constructed at the Whitewater Pit 512. The <br />Division will plan to inspect this construction during the next inspection trip to the Grand Junction area. <br />This should occur in the next couple of months. As stated in my 11-20-98 letter, topsoil replacement on <br />the island surface must be completed to avoid the requirement for dewatering of the lake. It is <br />recommended that some means of stabilization be employed to prevent loss of this topsoil to wind and <br />water erosion. <br />Additionally, if Whitewater Building Materials feels that construction of the first island is complete, and <br />would like to have that portion of the financial warranty released, then a request for a partial financial <br />warranty release should be submitted.
