TETRA TECH RMC
January 5, 2004
Ms. Madoline Wallace
Bernard, Lyons, Gaddis & Kahn
515 Kimbark Street
P.O. Box 978
Longmont, Colorado 80502-0978
RECE~4~;`
JAN 0 7 2004
Division of Minerals & Geology
Re: Review of Lafarge Rest, Inc. Proposed Duckworth Pit Mining Plan
Dear Ms. Wallace:
Lafazge West, Inc. (Lafarge) has submitted a Rule 1.4.5 Application for a new aggregate mining
operation at the Duckworth Pit (no DMG number). This review is provided on behalf of the Smith
& Emmons Ditch Company and relates to potential impacts due to mining on the Smith & Emmons
Ditch an irrigation conveyance currently crossing through the property.
Existing Conditions
The Smith & Emmons Ditch generally flows south to north in the area and enters the former
Duckworth property approximately 240 feet east of the southwest property corner. The ditch flows
across the property to a point approximately 460 feet east of the northwest property comer where a
lateral delivers water to the east, and the main ditch continues to the west around the reclaimed
gravel pit lake at Lighthouse Cove subdivision. Shareholders north and east of the Duckworth
property continue to take deliveries from the lateral and from the main ditch. Historically one share
of Smith & Emmons stock was used for irrigation of the Duckworth property and was included in
the sale to Mineral Reserves, Inc., a Lafarge subsidiary.
Review of Proposed Mining Plan
There is insufficient information presented in the. mine permit application materials to adequately
review and assess Lafarge's proposal to relocate the Smith & Emmons Ditch. The following
excerpts from the permit application represent the entire content of the application in that regard.
1900 5.
