Box 1061 <br />Paonia, Colorado 81428 <br />RE: Bingham Crushing <br />File No. 82-154 <br />On September 23, 1982, the Mined Land Reclamation Board acted on two matters <br />relating to the present status of the above captioned operation. They moved <br />to extend by five days the sixty day deadline by which you need to get a <br />permit application aporoved on this operation, such that the Board could <br />approve the application during the October meeting. They also moved to allow <br />you to crush yravel, as well as remove and stockpile yravel, under the terms <br />of the cease and desist order. <br />I have received the additional materials that you sent to make your application <br />complete. You should have already received the complete form Zetter with the <br />publication format on the back. As you know, this application must be <br />-~ published for two sequential weeks in a local newspaper and the proof of <br />publication (in the form of copies of the publications when you have them <br />and then a copy of the publisher's affidavit when it is available) should be <br />sent to our Pi vision. The landowner of the permit area and any imunediately <br />~' adjacent landowners should be sent a copy of the first publication by certi- <br />fied mail, and the gr~=en return receipts (or copies thereof) should be sent <br />to our Division. This should be accomplished before the next Board meeting. <br />I have a few questions and comments concerning the application materials. <br />I will organize them on an exhibit-by-exhibit basis below. Rny exhibits or <br />parts thereof not mentioned are considered adequate at this time. <br />Exhibits D and C <br />1. I4hat methods are to be employed to protect the river channel (during <br />both low and high taater) from increased sediment loads due to mining of <br />the gravel bars and the adjacent processing of gravel? In other words, <br />J how will drainage in these areas be controlled such that runoff does not <br />move sediment into thrs river? Sediment control structures such as berms <br />or ponds (if any) should he shown on the map. <br />. -. <br />
