Mr. Zachman also advised me that if the Nordykes succeed to the mining and <br />reclamation permit for this operation at some later date, they will not be <br />~ issued such a free use permit but instead, will have to pay the B.L.M. for the <br />gravel. If a succession of operators is done at some later time, we will need <br />`to get a copy of such a payment contract between the B.L.M. and the Nordykes <br />as a part of the succession of operators package. <br />Exhibit C and D <br />f <br />p ur~'yhl. You mention that the permit area is to be worked from east to west. <br />`~µ'~'F However, the north-south extent of mining is not discussed. An examation of <br />d" >(the maps indicates that only areas to the north of the creek drainage are to _ <br />-yQfM, be worked. Please clarify the north-south extent of mining. - <br />t Y ~ >[2. What is the estimated life of the mining operation? <br />ti`t~""*~3. lJhat is to be the depth of mining on the site? <br />4. If the area to the south of the stream drainage is not to be mined or <br />otherwise used as part of the mining operation, why is it included as part of <br />the permit area? If the southern area is to be affected by the Nordykes' - <br />operation after a succession to them, the mining plan and maps should reflect <br />those plans now, or the permit will need to be amended later. <br />5. Please clarify any potential effects on the active stream drainage across <br />Q ar(:yhtthe middle of the permit area. It appears that the present plan will not <br />affect the stream directly. Please clarify, however, the width of an <br />~ n bl4H undisturbed setback from the stream (100' minimum being typical). Please also <br />ye~M `describe the plans for protection of the stream from sediment (e.g., berming) <br />during and after mining. <br />t~eP. __ - <br />Exhibit G - <br />1. Please reference my comments above concerning protection of the stream <br />/~ drainage during and after mining. <br />Exhibit L <br />I °'U 1. Please submit a performance warranty for this operation. This will allow <br />d;~1t'lssuance of the permit as soon as the application is approved by the Board. <br />2. Since the Division of Highways does not submit financial warranties, we do <br />not typically do a detailed review of your reclamation costs. However, since <br />this permit may be succeeded to by the Nordykes, I will make a few brief <br />comments on your costs. Before this permit could be taken over by a private <br />operator, our Division would have to receive and approve a financial warranty <br />of an amount based upon detailed costs of reclamation. Such costs would <br />include both materials costs as well as labor and equipment usage costs. The <br />costs given in this exhibit include only materials costs. Any cost <br />
