Lamm Governor April 22, 1985 Mr. Dick Hines Colorado Division of Highways 4340 E, Louisiana Ave. Denver, Colorado 80222 Re: Nordyke Pit -File No. M-85-040 Dear {~4+~-Hues: I have completed my adequacy review of the 112 permit application for the Nordyke Pit and have a few questions that I have organized on an exhibit-by-exhibit basis below. As usual, any exhibits or parts thereof not mentioned are considered adequate for Board approval now. As per your request, I have scheduled this matter for the May 22-23, 1985 Board meeting. Please respond to this letter as far in advance of this meeting as possible. In this way, I will have time to review your responses and comment, as necessary, before the Board meeting occurs. I anticipate that this matter will be able to be handled as a "no problem" item, and. your presence at the meeting will thus not be required. - Before the Board can consider this application, we will need to have the proof of the four sequential weeks of publication (publisher's affidavit or a copy thereof) and the proofs of notification to the landowners, to any immendiately adjacent landowners, and to the B.L.M. (certified mail white or green receipts). Please send these items as soon as they are available. I have enclosed a copy of a protest letter (?) from an adjacent property owner. You may wish to contact him and ascertain exactly what his complaint is. Application Item 8 and Exhibits 0 and P 1. I spoke with Dennis Zachman of the Canon City office of the U.S. Bureau of Land Management on April 19, 1985. He informed me that the Department of ~ighways can be issued a free use permit for the gravel on the site, since the gravel is owned by the B.L.M. Evidently, he has informed Highways of the particulars for submitting the application for such a free use permit. Mr. Zachman advised me that this permit would almost certainly be issued prior to our May 22-23, 1985 Board meeting.
