<br />M-95-005/Adequacy <br />4/4/95 <br />page 4 <br />EXHIBIT M - OTHER PERMITS AND LICENSES <br />Though this is not a problem, I wish to clarify some language <br />contained in the county air emissions permit. Twice it mentions <br />that the existing permit {used at your MLRB permit M-90-145 site) <br />is sufficient to be used here also, because it is an "expansion <br />area." This new site is not contiguous to, nor an expansion of, <br />the other site, in the Division's eyes. It is a separate permit. <br />Please be reminded that because you propose to mine a hillside, and <br />the pit will daylight to the drainage path of the site, you may <br />have a potential for stormwater runoff, and if not contained, may <br />constitute an off site discharge. You should consider contacting <br />the Colorado Department of Health/Water Quality Control Division to <br />inquire about the need for a stormwater management permit on your <br />site. <br />EXHIBIT Q - PROOF OF MAILING NOTICES OF PERMIT APPLICATION <br />We discussed the fact that it appears the wrong soil conservation <br />entity was sent a notice by you. The Rules specify that if the <br />proposed site is situated within a "soil conservation district," <br />that district must be sent a notice. You must therefore notify the <br />Mesa Soil Conservation District, 2754 Compass Dr., Suite 170, Grand <br />Junction 81506. For technical assistance, the formerly-known Soil <br />Conservation Service (SCS) is whom to contact. That federal agency <br />is now called the Natural Resources Conservation Service (NRCS). <br />EXHIBIT R - PROOF OF FILING WITH THE COUNTY CLERK <br />Please be reminded that all future correspondence, maps, etc., must <br />also be placed on file at the clerk's office. <br />Please review the "Notice Procedures" as shown on page 3 of the <br />application packet {immediately before the actual application page <br />1). You must provide proof of notification of all owners of <br />affected land and all land within 200 feet of the proposed site. <br />The landowners, which should be shown on a map in Exhibit C, should <br />be notified. This would seem to include Mesa County (west, south <br />and east sides) and possibly owners to the northeast of the north- <br />central point (unless the boundary is modified there slightly <br />moving it southward). Acceptable proof may be return receipts of <br />certified mail. <br />I acknowledge that I received the proof of publication (as <br />corrected) from you during our meeting. The public comment period <br />ended on March 28, 1995, with no comment received, aside from the <br />item I mentioned under Exhibit G, above. <br />The decision date is still May 8, 1995. Please try to provide your <br />responses to me soon, I will begin the calculations for the bond <br />soon, but will delay final figures for a couple of weeks. <br />
