be contacted, nor will any operations take place if there is water in the creek-bed. Once <br />all useable material has been mined Lincoln County will not need to enter the creek-bed <br />again, even if storm run off replenishes the creek-bed. The operation will become a pit <br />operation after leaving the creek bed, with no drainage or run offoccurring back into the <br />creek, this will be accomplished by a berm, if needed, and once the pits starts forming <br />from the extraction of material it will slope into the pit which allows storm water to drain <br />into the pit and not the creek-bed. At no time will material be removed from the eastern <br />high bank of the creek-bed, or will there be any disturbance to that area. Material with the <br />wit operation will be scrapped up by a bull dozer, or pushed up with an end loader placed <br />in stockpiles for loading into trucks to be used for road repair and maintenance within <br />Lincoln County. <br />All topsoil and overburden will be salvaged to be used in reclamation of the azea and <br />stored within the pit boundaries to the north, and if needed stabilized with a fast growing <br />seed such as fortis or prosso millet, to control erosion, should the stockpiles not <br />revegetate on their own. Topsoil runs to 6 to 10 inches in places and the overburden to 20 <br />inches as you move away from the creek banks to the north. Sand and gravel is plentiful <br />through out the pit area with enough material that the life of the pit will be 20 years or <br />more. <br />Every means will be taken to minimize any possible disturbance to the hydrologic <br />balance by exposing only minimal amounts of surface azea at any given time. Efforts will <br />be made to keep all sloping at 3:1 during the Honing operation. According to the special <br />soil survey the soil in the area is fast draining so run off erosion should not be a problem, <br />but if needed any area that shows signs of erosion will be seeded with a fast growing seed <br />mixture to stabilize it. <br />The primary commodities will be sand and gravel with no secondary commodity taken. <br />EXHIBIT D <br />Reclamation Plan <br />No reclamation will take place in the creek-bed but will be needed on the bank as well as <br />the pit azea. Reclamation of the area will be on going during active mining with sloping <br />taking place and any area will be seeded if needed with the recommended seed of the <br />N.R.C.S. Sloping will be at 3:1 or less and every effort will be made to match the <br />surrounding topography, without allowing any storm-ranoffto drain into Dugout Creek <br />from the pit area. The remaining pit area will be le8 closed to hold water for live stock as <br />the area is range land. Topsoil will be stockpiled along with overburden and will be used <br />in the reclaiming of the area and replaced at a depth of 6 inches and chiseled in along <br />with any augmentation that is recommended by the N.RC.S prior to seeding. If there is <br />insufficient topsoil stockpiled then more will be imported. If needed stockpIles will be <br />seeded to prevent erosion with a fast growing seed such as prosso millet to help stabilized <br />them if re-vegetation does not occur naturally. <br />
