Exhibit E, Titled Mining Plan Map, contains a stockpile that is located outside of the permit <br />area. The pile is labeled " 2"Minus for Property Owner 14,000 Ton." In order for the <br />Division to approve a stockpile located outside of the permit area it must be approved by the <br />Mined Land Reclamation Board to ensure that it is not mining related activity outside of the <br />permit boundary. Attached, Please find the "Need for a Reclamation Permit" policy adopted <br />by the Board. As an alternative, the operator can locate the pile within the permit boundary. <br />Please be advised that River Park Recreation Access New 110 Application maybe deemed <br />inadequate, and the application maybe denied on October 31, 2005 unless the above-mentioned <br />adequacy review items are addressed to the satisfaction of the Division. If you feel more time is <br />needed to complete your reply, the Division can grant an extension to the decision date. This <br />will be done upon receipt of a written waiver of your right to a decision by October 31, 2005 and <br />request for additional time.
