LOn~; D in eon Director RE: Citizen Complaints, Colona Pit, Permit No. M-94-005, Montrose County Dear Mr. McGehee: Enclosed are copies of correspondence the Division received from Janice and Dorothy Becker regarding operations at the Colona Pit. As you know, the Becker residence is located just north of the Colona Pit permit boundary. It appears, from their letters, that your operations are causing problems for the Beckers due to your hours of operation, the dust from the crusher and excavation activities, because you apparently moved their mailboxes and are parking equipment at the entrance of their access road. Dorothy Becker says you and Sprague Mayger had agreed with the Beckers to limit your operating hours from 7:00 a.m. to 5:00 p.m. I reviewed the files but did not find any evidence, or document, that an agreement had been entered into relating to the limitation of operating hours. If this was a verbal agreement with the Beckers you might consider complying with the limitations. The Division does not have jurisdiction in this matter since it is not part of the approved permit so we cannot enforce the agreement (if, in fact, you made one). You, unfortunately, decided to begin operations at the pit about the same time the area was "bombarded with gale force winds". A lot of the dust, apparently, ended up in the Becker's house. When Dorothy Becker called me in May, complaining about the dust, I told her to contact the Department of Health, Air Emissions, because this matter came under their jurisdiction. Mr. Todd Richardson was told to contact the Department of Health when he called about the dust problem. Since I am not familiar with federal postal regulations, I really can't comment about the removal and reinstallation of the mail boxes. You may want to contact the local postal authority and inquire about the specifications of the mail boxes you moved.
