LOn~; <br />D in eon Director <br />RE: Citizen Complaints, Colona Pit, Permit No. M-94-005, <br />Montrose County <br />Dear Mr. McGehee: <br />Enclosed are copies of correspondence the Division received from <br />Janice and Dorothy Becker regarding operations at the Colona Pit. <br />As you know, the Becker residence is located just north of the <br />Colona Pit permit boundary. It appears, from their letters, that <br />your operations are causing problems for the Beckers due to your <br />hours of operation, the dust from the crusher and excavation <br />activities, because you apparently moved their mailboxes and are <br />parking equipment at the entrance of their access road. <br />Dorothy Becker says you and Sprague Mayger had agreed with the <br />Beckers to limit your operating hours from 7:00 a.m. to 5:00 p.m. <br />I reviewed the files but did not find any evidence, or document, <br />that an agreement had been entered into relating to the <br />limitation of operating hours. If this was a verbal agreement <br />with the Beckers you might consider complying with the <br />limitations. The Division does not have jurisdiction in this <br />matter since it is not part of the approved permit so we cannot <br />enforce the agreement (if, in fact, you made one). <br />You, unfortunately, decided to begin operations at the pit about <br />the same time the area was "bombarded with gale force winds". A <br />lot of the dust, apparently, ended up in the Becker's house. <br />When Dorothy Becker called me in May, complaining about the dust, <br />I told her to contact the Department of Health, Air Emissions, <br />because this matter came under their jurisdiction. Mr. Todd <br />Richardson was told to contact the Department of Health when he <br />called about the dust problem. <br />Since I am not familiar with federal postal regulations, I really <br />can't comment about the removal and reinstallation of the mail <br />boxes. You may want to contact the local postal authority and <br />inquire about the specifications of the mail boxes you moved. <br />
