EXHIBIT C <br />Mining Plan <br />a) Mining is estimated to commence upon pennR approval and to continue for an indefinite <br />time. <br />b) Approximately 2 inches of plant growth medium will be salvaged and stockpiled in the <br />mining area for use in the reGamation process. <br />c) Approximately 12 inches of overburden needs to tie removed to reach the deposits. <br />d) Sand/gravel deposits vary in depth with a 5 foot average. <br />e) An existing road will be used to access the mining area from State Highway 14. There <br />will be no office, maintenance buildings, plant or underground openings. <br />f) PR excavation will be limited to a 7 acre area. The limits of mining were determined by <br />the area cleared of trees. The lease and permit boundaries are marked wRh rebar and <br />red flagging. The excavation will be done from the west to the east. <br />g) The haul road and access to the county road are already established. <br />h) There will be no water used in conjunction with this mining operation. <br />i) We do not anticipate encountering any ground water on site. <br />j) Colorado water laws and regulations governing injury to existing water rights is not <br />applicable in this operation. <br />k) The affected area is located in a rural area and no refuse, acid or toxic producing <br />materials will be encountered. If these materials are found, they will be disposed of as <br />specfied by Colorado laws and regulations. <br />I) The mining is to remain above the water table and at least 100 feet away from the <br />Michigan River. The depth of excavation shall be limited to at least two (2) feet above <br />water table at all times, In the event that ground water is exposed, the operator will <br />cease excavation, notify the Division within 24 hours of the exposure, and backfill to an <br />elevation at least two (2) feel above the exposed water. Silt fencing is to be installed <br />along the west boundary to prevent any deposit into the river. <br />m) The only time processing equipment would be on site is if a screening plant would be <br />rented and used to screen material. This would be for only a short period of time. <br />nj The primary commodities to be mined will be sand and base material for focal use. <br />o) There will be no incidental products mined other than those previously described. <br />
