(ALSO KNOWN AS THE OPHIIt-NEVADA MINING <br />COMPANY) TO CONDUCT A MINING OPERATION Wl'I'HIIV HINSDALE COUNTY <br />UNDER THE STATE OF COLORADO'S LIMIIZD IMPACT (110) PERMIT PROCESS <br />WHEREAS, the Board of Coumy Commissioners are authorized under Article 28, Title 30 of the <br />Colorado Revised Statutes to apply zoning regulations to a0 or part of the Couttty; and <br />WHEREAS, the Board of County Commissioners Gave previo~ssly adopted a Resolution <br />Establishing Zoning Districts for Hinsdale Coumy, Colorado; and <br />WHEREAS, it is in the best interests of the County to allow certain exceptions to the zoning <br />regulations upon proper application for a special use permit to the Board of County <br />Corrmiissioners; and <br />WHEREAS, section 5 of the County Zoning Regulation allows for and prescribes the <br />appropriate procedures to apply for a special use permit; and <br />WHEREAS, the Midas Mining Company, Inc., has properly applied to the various State of <br />Colorado and federal agencies and has received the necessary petrnits; and <br />WHEREAS, the Midas Mining Company, Inc, has also properly applied to the Board of County <br />Commissioners and met the necessary requirements of the county zoning resolution; and <br />WHEREAS, after proper advertisemerrt, a public hearing concerning the proposed special use <br />permit was held by the County Commissioners at their February 5 and March 5, 2003 meetings; <br />and <br />WHEREAS, after consideration of public comments to such proposal, and determination than the <br />questions and requirements listed in Section 6 of the county zoning resolution can be properly and <br />reasonably mitigated, the Board of County Commissioners finds that the proposed use is in the <br />overall best interest and welfare of the citizens of the Corrrtty. <br />
