PARTI <br />Page No. 12 <br />Permit No.: CO-0038776 <br />2. Stormwater Requirements <br />a. Stomrwater Management Plan {continued) <br />Factors to consider include the toxicity of the material; quantity of chemicals used; amount of material processed; the <br />likelihood of contact with stormwater; and history of significant drainage, leaks or spills of toxic or hazazdous <br />pollutants. <br />The description of the BMPs shall include: <br />1) Stormwater diversion: Describe how and where stormwater will be diverted away from material handling and <br />storage azeas to prevent stormwatet contamination. <br />2) Materials handling and spill prevention: Where materials can t' act stormwater runoff; ppractices that reduce the <br />potential for contamination shall be described and implemented. For example, tnatenals should be stored and <br />handled in covered azeas to prevent contact with storrrtwater; chemicals should be stored within beans or <br />secondary containment devices to prevent leaks and spills from entering stormwater runoff. <br />3) Sediment and erosion prevention: Describe practices that will be used to reduce erosion and prevent sediment <br />delivery to State waters. These could include stmctural (such as silt fences, sediment ponds, drop structures, check <br />dams) and non-stmctural (such as mulching and revegetation) methods. <br />In each case where stormwater pollution potential exists, appropriate preventive measures must be identified and <br />implemented. <br />c) Preventive Maintenance -The SWMP shall identify a preventive maintenance program. This program shall involve <br />maintenance of stormwater management devices (maintenance of dikes separating mine drainage from stormwater, <br />cleaning oiUwater sepazators and catch basins, etc.) as we]] as inspectingg and testing of equipment and systems to <br />prevent conditions that could cause breakdowns or failures resulting in dtscharges of pollutants to surface waters. <br />d) Good Housekeeping -The SWMP shall identify good housekeeping procedures that will be followed by the m~~ng <br />operation. Good housekeeping requires the maintenance of a clean, orderly facility. This part of the SWMP shall <br />address cleaning and maintenance schedules, trash disposal and collection practices, grounds maintenance, etc. <br />e) Spill Prevention and Response Procedures -Areas where potential spills can occur, and their accompanying drainage <br />pq~nts, shall be identified cleazly in the SWMP. Where appropriate, spectfying material handling procedures and <br />storage requirements in the plan shall be considered. Procedures for cleaning up spills shall be identified in the plan <br />and made available to the appropnate personnel. The necessary equipment to intplement a clean-up shall be available <br />to personnel. <br />fl Employee Education -The SWMP shall describe employee education programs to inform personnel at all levels of <br />responstbiltttyy (who aze involved in mining activities that ma mtpact stormwater runoff) of the components and goals <br />of the SWMP. Education shall address topics such as spill response, good housekeeping and material management <br />practices. The SWMP shall identify periodic dates for such instmction. Contractor or temporary personnel shall be <br />urformed of mine operations and control features in order to prevent stormwater pollution from occurring. <br />g) Identification of Discharges other than Stormwater -The stormwater conveyance system on the site shall be evaluated <br />for the presence of discharges other than stormwater. The SWIvL° shall incl.:de a description of the results cf any <br />evaluation for the Qresence of dischazgges other than stormwater, the method used, the date of any evaluations and the <br />on-site drainage potnts that were duecfly observed dozing the evaluation. <br />A number of dischazges other than stozmwater tnay not require a CDPS Wastewater Dischazge permit and aze <br />considered Allowable Non-stormwater Dischazges. These are hsfed a! Part I)D.3, below. Any of these dischazges that <br />exist at the site must be identified in the SWMP. <br />v) Comprehensive L~spection <br />The SWMP shall identify qualified persotmel that shall inspect desi~ated equipment and mine azeas at appro riate <br />intervals specified in the plap, at least twice a yeaz (in the spring and fall). The operator shall keep a record ofpsuch <br />inspections. This record shall be made available to the Division upon request and snmmar,~ed in the Annual Report (see <br />Part LE.1 of the permit). <br />vi) Consistency with Other Plans <br />SWMPs may reflect requirements for S ill Prevention Control and Countermeasure (SPCC) plans under section 311 of the <br />CWA, or Best Management Practices (pBMPs) Programs otherwise required by a C PS pemnt, and may incorporate any <br />part of such plans into the SWMP by reference. The SWMP ma rely upon information developed for other similaz <br />pollution control programs, including the Mined Land Reclamation Plan. Appropriate portions of these other plays maybe <br />incorporated in the SWMP by reference, as long as a complete SWMP can be reproduced and submitted to the requeshno <br />agency anthin the time frame specified in the request. Those portions of the referenced documents must be included in th'e <br />submtttal. The SWMP must also be readily available to an on-srte inspector. <br />The Stormwater Management Plan (SWMP) for West Elk Mine shall be developed to cover the inactive pportions of the <br />mine. The plan shall rdentify potential sources of pollution (including sediment) which may reasonably be expected to <br />affect the quality of stormwater dischazges associated wtth the inactive mining operation. In addition, the plan shall <br />describe and ensure the implementation of best management practices (BMPs) wlvch wtll be used to reduce the pollutants in <br />stormwater dischazges assoctated with the inactive mtmng operation and to assure compliance with the temrs and conditions <br />of this permit. <br />xe.~ea atsrzooa <br />
