There are locations at Mine 3 that will require small area exemptions as provided for under
Rule 4.05.2(3), six of which have previously been approved. These areas are as follows:

1) M3S Access Area -includes some 4 acres of distrubance adjacent to the
intersection of County Roads 179 and 33. Flow from this area travels through a
diversion to a culvert leading to a rock filter.
2) Ditch P1 Area -includes some 1.6 acres of narrow strip which is bordered by Ditch
P1 on the west and County Road #179 to the east. Flow collects at and moves
through a culvert some 750 feet north of the intersection of County Road #33 with
County Road #179. All flow is filtered by established vegetation or conveyed to
a rock filter before reaching Middle Creek.
3) Homestead Ditch Exemption One -includes 16.8 acres of 1983 seeding upslope
of the Homestead Irrigation Ditch. The area was seeded with fast-establishing
grasses, and was contour furrowed. CYCC has agreed to provide a demonstration
that the area does not contribute excessive sediment loads to the irrigation ditch.
• This demonstration will include the collection of samples from the ditch for
analyses of Suspended Solids (both before and immediately after a precipitation
event- during irrigation flow, and an assessment of erosion potential.
41 Middle Creek Office Area -includes 2.0 acres surrounding the Middle Creek Office
consisting primarily of driveway, storage, and parking areas. Flow from this area
is collected by a ditch around the perimeter of the exemption, and is channeled to
a rock filter before entering Middle Creek.
5) Middle Creek Office Topsoil Stockpile -includes some 0.5 acres approximately 500
feet southwest of the Middle Creek Office exemption. The combination of slope,
vegetative cover, and distance of that overland flow must travel preclude sediment
reaching Foidel Creek.
6) Homestead Ditch Exemption Two -Includes some 25 acres of 1986 seeding
upslope of the Homestead Irrigation Ditch. The area was seeded with fast
• establishing grasses, ripped, and contour furrowed. Flow is filtered by vegetation
MR 92-16 Exhibit 3 - 39 Revised 11!04/92
