Box 158 <br />Jefferson, Colorado 80l~56 <br />836-2593 935-8958 <br />To Whom it May Concern: <br />Following is a few questions we at Universal Peat, Sand and Gravel Inc. <br />Merrill Wright- President, Roy~vlright- Secretary, Robert Wright- Assittant Secretary <br />as owners ane operators of said pit. Several questions have been brought to <br />our attention while we were applying for a 110 gravel permit which is actually <br />a continuation of a 111 permit taken out by Kirkland Construction Co. of <br />Rye Colorado. <br />In examining the Mined Land Wildlife application we noticed that <br />restrictions on mining on said fit was limited to a seasonal operation <br />which would limit us or anyone else to a no mining clause from December 1st <br />to April 1st. This of course we feel would be totally unacceptable under <br />any conditions, unless the Wildlife Division can prove under the laws and <br />regulations that they are legally justified in their decision. <br />We are at present in the process of buying all or part of the land in <br />question. If however we are bound by your decision it would greatly decrese <br />the value of the property. <br />We feel under the present circumstances we are being denied our legal <br />rights. We would like to bring to your attention the fact that we are members <br />of the Soil Conservation of Teller .~~i3 Park County and that we have and will <br />continue to abided by all rules, regulations set forth by the counties, <br />Soil Conservation and State of Colorado, County Commissioners, Zoning and <br />Planning Board in protecting said land by the reclaming the land that <br />ie insured by bond. It is our intentions and desires to put back in place <br />all gxasa disturbed by the mining operation in as good if not better condition:; <br />than orginal. <br />In the 110 mining laws of the Land Reclamation Laws it contends that <br />no more land is to be mined than the 9.9. acres and that the land shall <br />be reclaimed as stated in the reclamatione laws set forth by the Mine Land <br />Reclamation Division. We feel that we could agree to th restriction of <br />not mining over 9.9 acres as stated above in the Mine Land Reclamation <br />Division Laws. This we feel would protect everyonea best interest. <br />However, we contend that when the land is reclamed we question what <br />legal authority gives the Wildlife or State Game and Fish the right to <br />graze the elk on our property, taken away our right to graze cattle because <br />of the shortage of grass caused by the elk destroying of fences and the shut <br />down of a operation for four months. <br /> <br />
