Fact Sheet: <br />Owens Bros.' Nix Sand and Gravel Mine <br />ISSUES AND RESPONSE: <br />Issue: <br />Concrete Batch Plant located on site. <br />Response: <br />As a result of community concern, the concrete batch plant aspect of the permit <br />has been formally withdrawn from the application. <br />Issue: <br />No efforts have been made to address possible impacts to groundwater supplies. <br />Response: <br />As required by the Division of Water Resources, State Engineer's Office, a <br />Temporary Substitute Supply Plan has been prepared and submitted for review <br />and subsequent approval. The Division of Water Resources requires that an <br />approved Substitute Supply Plan be acquired before any mining takes place on <br />any proposed sand and gravel mine. Further, the division of Water Resources <br />will not approve a Plan unless it satisfactorily addresses all concerns regarding <br />groundwater impacts on water tables, aquifers and nearby wells (within 600' of <br />the proposed mine). Lastly, Owens Bros. Concrete will obtain water rights in the <br />Last Chance Ditch that will provide approximately 438 acre-feet per year of water <br />that can be used to offset any adverse affects on surrounding water supplies. <br />Issue: <br />The life of the operation as proposed is open-ended. <br />Response: <br />The life of the operation is not proposed to be open-ended, with no end-date. <br />The USR permit states that under the mining rates that Owens is expected to <br />achieve, the operation will last between 18 and 22 years. The Phase II Area <br />indicated on the Mine Plan Map is excluded from mining under this proposed <br />
