<br />ATTACHMENT A <br />SPECIAL STIPULATIONS <br />FUP# COC 61232 <br />Moffat County Road Department <br />T. 9 N., R. 96 W., 6th P.M., <br />sec. 4: SE'/., SE'/. <br />sec. 9: N'h, NE'/. <br />Pit rehabilitation shall consist of the following requirements: <br />a. All rejected oversized material will be buried in the excavation prior to rehabilitation. <br />b. The pit walls shall be sloped to blend with surrounding existing contours, not to exceed 4h:1v. <br />c. The pit segment floor and access routes are to be disked or ripped to loosen compacted soils. <br />d. Stockpiled topsoil shall be spread evenly over the sides and bottom of the pit segment excavation. <br />Any cultural and/or paleontological resource (historic or prehistoric site or object) discovered by <br />the holder, or any person working on his behalf, on public or Federal land shall be immediately <br />reported to the authorized officer. Holder shall suspend all operations in the immediate area of <br />such discovery until written authorization to proceed is issued by the authorized officer. An <br />evaluation of the discovery will be made by the authorized officer to determine appropriate <br />actions to prevent the loss of significant cultural or scientific values. The holder will be <br />responsible for the cost of evaluation and any decision as to proper mitigation measures will be <br />made by the authorized officer after consulting with the holder. <br />The upgrade of County Road 26 from MCR 21 into the gravel pit will be based upon the Counties <br />letter October 22, 1998 and will include that in the area of the terrace edges and in the areas of <br />SMF4424 there will be NO bulldozer blading below the six inches of pit-run base course and two <br />inches of road base, a total of 8 inches. If any road surface repair is needed in these areas it will <br />be limited to placing more road base in these areas. This is to protect the known site and any <br />buried sites found in these areas. <br />The county will be respopsible to see that the road in these areas is maintained in such a manner <br />that the protective surface is in place during the operation of the pit. The county will be <br />responsible for mitigatioty of.the cultural sites, SMF4424 and any buried site(s) that may be <br />impacted as a result of road damage that exposes cultural materials below the 8 inches described <br />in the October 22, 1998 letter. Once the pit is closed and reclaimed this stipulation will no longer <br />apply to the County. <br />3. Pursuant to 43 CFR 10.4(g) the holder of this authorization must notify the authorized officer, by <br />telephone, with written confirmation, immediately upon the discovery of human remains, funerary <br />items, sacred objects, or objects of cultural patrimony. Further, pursuant to 43 CFR 10.4(c) and <br />(d), you must stop activities in the vicittity of the discovery and protect it for 30 days or until <br />notified to proceed by the authorized officer. <br />4. No hazardous materials/hazardous wastes, trash or other solid waste shall be disposed of on public <br />Exhibit 1; page ,#3 <br />
