HESS <br />and LULU D7AE HESS, Lessors, and ALTON HESS, Lessee; <br />W I T N E S S E T H: <br />That for and in consideration of the mutual covenants herein <br />contained and in consideration of the payment of royalties as <br />hereinafter set out, Lessors lease unto Lessee a gravel-bearing <br />area in the County of La Plata, State of Colorado, to-wit: <br />An area of approximately nine and one-half acres which lies <br />in the East 1/2 of the SW/4 SE/4 of SS T33N R9W. <br />1. The lease term is for five (5) years commencing on <br />the date hereof. <br />2. Lessee shall have the option to renew this lease for <br />an additional five year term by giving to Lessors notice of <br />his intention so to do in writing at least thirty days before <br />the expiration of the primary term hereof. <br />3. Lessee shall pay to Lessors as royalty for this Lease <br />the sum of $.40 per cubic yard for each cubic yard of gravel <br />mined and removed. <br />4. Lessee shall reclaim the land as prescribed by the <br />Bureau of Mined Land Reclamation aforesaid within twelve (12) <br />months after cessation of gravel mining operations. <br />5. Lessee shall have the right to move a gravel crusher <br />onto the leased premises and to operate the same. <br />6. Lessee shall have the right of use of a private road <br />within a 60 foot right of way from the leased property to U.S. <br />Highway 550 along the south and west boundary of a tract in <br />the N1/2 SW1/9 SS T33N R9W and along the south boundary of a <br />tract in the S1/2 NW1/4 SS T33N R9W and U.S. Highway 550. Lessee <br />shall be responsible for the maintenance of aforesaid road. <br />7. Lessee is entitled to 75 gl/min. of water from Teti <br />Springs during operational periods. Water is adjudicated to <br />Lessor. <br />
