Barry, I I I, <br />Director <br />Mr. Lee Tucker <br />Impact <br />1409 Larimer Square <br />Denver, Colorado 80202 <br />RE: Tucker Aggregate Permit Application <br />Our File X80-2 <br />Dear Mr. Tucker: <br />We have reviewed the application prepared by Impact for your proposed <br />aggregate mine 2-''-i miles northwest of Carr. At this time there are <br />significant inadequacies which need to be corrected before we can go to <br />the Board requesting approval of this permit. <br />A major issue is the lack of clarity as to what acreage will be .mined. <br />Item 13 on the permit application form states that there will be 220 <br />acres of affected land which will be the total surface acreage to be <br />included in the permit. This, however is in direct conflict with exhibit <br />A which describes the permit area as including 3,299.77 acres. The fee <br />paid indicates that the 220 acres is what you intend for this application <br />to cover, however, the maps do not delineate the specific 220 acres. <br />This issue has ramification throughout the application, as noted in the <br />following specific comments on the various exhibits required for a <br />complete application. <br />Exhibit A - Legal Description: <br />No proper legal description was included in the application. Please <br />submit the legal description of the affected land (see 34-32-103(1) <br />for definition) by reference to too-mship, range, and section to at <br />least the nearest quarter-quarter section. <br />Exhibit C - Pre-Mininq and Mining Plan Maps of the Affected Lands: <br />1. Adjacent Landowners <br />You have shown the adjacent lando~,mers for the 3,299.77 acres, even though <br />it appears that the actual affected land o-rill be 220 acres. There <br />certainly is no prcblem infornting other landowners if you wish, but <br />you are only required to inform those adjacent to the affected land, <br />which should be your permit area. The outline of the affected land <br />and permit area should be clearly shown along with the adjacent <br />boundaries of the landowners ~vhose property abuts the perimeter of <br />the permit area. . <br />(cont'd) <br />January 28, 1980 <br />
