COLORADO DEPARTMENT OF HEALTH
. Water Quality Control Division
4210 East 11th Avenue
Denver, Colorado 80220
RATIONALE
At4ENDMENT 113
EMPIRE ENERGY CORPORATION
EAGLE MINE COMPLEX
PERMIT NUMBER CO-0034142
MOFFAT COUNTY
In a letter of October 13, 1986, the permittee has described the mine domestic
xastewater treatment facility's (WWTF) inability to comply with Part I.A.4. of
the permit (Percentage Removal Requirements). The WWTF treats mostly shower
• water sad as a result, the influent is relatively low in BOD and TSS. There
is no problem complying with BOD and TSS numerical effluent limitations.
Section 40 CFR 133.103(d) of the federal regulations authorizes substitution
of either a lower Percent Removal Requirement or a mass loading limit for the
85X removal requirement where effluent concentration limits are being met.
This permit now contains mass loading limitations Cin addition to
concentration limitations) for BOD and TSS, which are being met. Therefore,
the Percent Removal Requirement can be deleted.
Part I.A.4. will be deleted. Page lc of the permit will be affected.
Jon C. Kubic
November 4, 1986
•
