There are no users of surface waters or persons who have water rights in, or adjacent <br />to, the permit area other than the present landowner. The potential impact to the <br />nearest ground water wells has already been addressed in Section 2.04. OEI will <br />pursue obtaining the necessary priority numbers for the water it develops during the <br />course of mining activities. Adjudication can occur after beneficial use actually occurs. <br />The quantity of water, both surface and underground, will be protected from adverse <br />effects of the mining operation. All surface water originating in and above the <br />drainage area will be allowed to flow to the Animas River as it always has.
