• Post-11Tining land Use Feasibility <br />Where necessary, the rules require a feasibility demonstration of the post-mining land <br />use related to projected land use trends and markets. This demonstration and <br />accompanying plans aze not necessary, as the landowner is the developer and operator <br />of the commercial ventures taking place on the property. As such there will be no <br />outside interests which will dictate land use trends and/or mazkets. Landowners are <br />entitled to conduct operations and businesses on their own property which aze <br />consistent with the approved general land uses. Successful reclamation will be <br />accomplished on disturbed azeas within the permit azea boundary which would not be <br />of use in the development, construction, or operation of the planned and approved land <br />uses. Designation of an alternative land use would in no way hinder reclamation. <br />Where modifications to the approved reclamation plan are required to best serve the <br />approved post-mining land uses, Oakridge Energy will secure these prior to initiation. <br />Public flealt6 and Safety <br />The proposed uses would not present actual or probable hazard to public health or <br />safety, nor actual or probable threat of water flow diminution or pollution. Residential <br />and recreational development is regulated by the La Plata County Planning Department. <br />• Public health and safety issues aze therefore addressed within the context of their <br />review and approval of projects. Public health and safety issues for the operation of <br />the industrial and commercial ventures will be regulated by MSHA (mining) and <br />OSHA (other commercial ventures). For the existing land uses as described above, the <br />required development, operation, and reclamation permits have been or will be <br />secured. <br />Reclamnlion Delays <br />As these land uses have already been implemented, there would be no delay in <br />reclamation of the mine site attributable to implementation of the post-mining land <br />uses. <br />Fysb and Wi/dGfe {'a/ues <br />This rule pertains to alternative land use changes proposed during a permit application <br />process and prior to surface coal mining operations.
