Reclamation of the af.f_ected portions of the leased premises <br />shall be in accordance with the Colorado Land Surface Reclamation <br />Act, and to applicable Federal Laws, if any. <br />• F. Lessee's operations shall be in accordance with sound <br />industry practices designed or intended to obtain the greatest amount <br />of material with the least amount of waste. <br />G. Lessee accepts the leased premises in their existing con- <br />dition and shall defend, save and hold the Lessors harmless from any <br />and all claims, liabilities, damages and charges of any kind or <br />character arising from or out of the Lessee's operations on the <br />leased premises hereunder. <br />During the lease term, Lessee shall be responsible for <br />maintaining all roads actually used by it in as good condition as <br />at the inception of the lease. <br />H. Lessee shall not willfully refuse to sell material produced <br />from the leased premises to any third person or persons, this pro- <br />vision, however, shall not prevent Lessee from utilizing reasonable <br />business prudence and judgment in determining an appropriate price <br />to be paid by such third person or persons for material produced <br />from the leasehold. <br />11. Obligations Of Lessors: <br />A. Lessors warrant that they have good, merchantable <br />title to the leased premises and the lands over which the <br />roadway providing access thereto passes, and have good right <br />and lawful authority to execute this lease, <br />B. Lessors will defend and hold and save the Lessee <br />harmless from any and all claims, damages, charges or liabilities <br />arising from any alleged deficiency or alleged lack of such <br />merchantable title. <br />C. If requested, Lessors will make such title information <br />and evidences as they now have available to the Lessee for its <br />examination. <br />
