Cattany <br />12353 State Highway 14 Division Direttor <br />Walden, C0 80480 Natural Resource Trustee <br />RE: Request for Transfer of Permit, VanValkenburg Pit, Permit No. M-2002-077 <br />Dear Mr. Van Valkenburg: <br />Recently we received an application for a transfer of permit for the Van Valkenburg Pit, Permit <br />No. M-2002-077. Unfortunately, we cannot process the transfer request as our Construction <br />Material Rules and Regulations do not allow for the transfer or conversion of a Special 111 <br />Operation Permit, such as for the Van Valkenburg Pit. The only permitting option available to <br />either you or Kirkland Construction is for either of you to submit an application for a <br />Construction Materials 110(2) or 112 permit to overlap the current disturbed acreage. A Limited <br />Impact 110(2) Permit would be required if the current and planned disturbance is 9.99 acres or <br />less. A Regular 112 Permit would be required if the current and planned disturbance is 10.0 <br />acres or more. Once a 110(2) or 112 permit is issued for the current and planned disturbance, <br />Kirkland Construction may request a complete financial warranty release for the remaining <br />acreage of their 30 acre permit that has not been disturbed by mining activities. Their fmancial <br />warranty, Bond No. SM5936 will be released at that time.
