Cattany <br />Division Director <br />Natural Resource Tmstee <br />We appreciate your November 22, 2004 request for a transfer of permit for the Van Valkenburg <br />Pit, Permit No. M-2002-077. Unfortunately, we cannot process your request as our Construction <br />Material Rules and Regulations do not allow for the transfer or conversion of a Special 111 <br />Operation Permit, such as for the Van Valkenburg Pit. The only permitting option available to <br />either Kirkland Construction or the landowner, Mr. Van Valkenburg, is to submit an application <br />for a Construction Materials 110(2) or 112 permit to overlap the current disturbed acreage. A <br />Limited Impact 110(2) Permit would be required if the current and planned disturbance is 9.99 <br />acres or less. A Regulaz 112 Pemut would be required if the current and planned disturbance is <br />10.0 acres or more. Once a 110(2) or 112 permit is issued for the current and planned <br />disturbance, you may request a complete fmancial warranty release for the remaining acreage of <br />your 30 acre permit that has not been disturbed by mining activities. Your financial warranty, <br />Bond No. SM5936 will be released at that time.
