' Water rights for the mill have been obtained by the purchase
of 20 shares of stock in the Left Hand Ditch Company, which
entitles CON Inc. /Homestate, Inc. to a pro-rata share of the
' water available from Left Hand Creek. Based upon the
historic diversions associated with these water shares, the
milling complex is entitled to a minimum of 10. 4 acre feet of
' water per year in a dry year, and a maximum of 22. 53 acre
feet of water in a wet year. COX Inc. intends to divert the
water associated with these shares from a point of diversion
located on the south bank of Left Hand Creek, on property
' on which arrangements have been made with present owners to
use. These diversions will be made at a maximum rate of 50
gallons per minute during the irrigation season, which
' extends from April 1 to October 31 . A continuous measuring
device will be installed at the point of diversion. Access
will be granted to the Left Hand Ditch Company' s
' representatives, and to the State of Colorado' s water
officials, to enable them to monitor the amount of water
being diverted for milling operations.
' From the point of diversion, the water will be pumped 3,900
feet up Aikens Gulch in a 3 inch diameter pipeline, with two
lift stations. At a location 45 feet below County Road No.
' 52, the water line will enter the portal of the Times mine' s
adit, which passes beneath the county road, and extends 395
feet in a southeasterly direction. The Times mine is
' connected with the first level of the Wynona mine by way of a
50 foot deep winze. By constructing a bulkhead in the Times
mine, and pumping the water from Left Hand Creek behind this
bulkhead, both the Times and Wynona mines can be used for the
' underground storage of water for milling purposes. Together,
these two mines will have sufficient capacity to store enough
water to carry the milling operation through the period
' between November 1 and May 31. Mill water will be drawn from
these mine workings by pumping water out of a drill hole in
the top of the Times mine (see Map E) .
' The COX Inc. /Homestate, Inc. concentration mill is housed in
a metal building 70 feet wide, 120 feet long, and 30 feet
high, with three separate working levels. A metal frame
' building was constructed on a concrete foundation with an
upper elevation of 8, 590 feet, an intermediate elevation of
8, 585 feet, and a lower elevation of 8, 575 feet. The upper
' terrace supports the crushing plant and the grinding circuit,
the middle terrace contains the gravity concentration
circuit, and the lower terrace encloses the flotation
concentration circuit. Construction of these three levels,
and the two retaining walls that separate the middle level,
required some excavation of the underlying granite, and
Involved cut and fill grading. excavation of the site, and
' construction of the retaining and foundation walls,
were followed by the installation of the heavy crushing and
milling equipment. Special reference was given to the
support of the heavy or vibrating machinery that are used in
